According to Article 112 of the Labor Code of the Russian Federation (hereinafter referred to as the Labor Code of the Russian Federation) (as amended by Federal Law No. 35-FZ dated April 23, 2012), non-working holidays in the Russian Federation are:

  • January 1, 2, 3, 4, 5, 6 and 8 — New Year holidays;
  • January 7—Christmas Day;
  • February 23 - Defender of the Fatherland Day;
  • March 8—International Women's Day;
  • May 1 - Spring and Labor Day;
  • May 9 - Victory Day;
  • June 12—Russia Day;
  • November 4 is National Unity Day.

The Labor Code of the Russian Federation establishes that if a day off coincides with a non-working holiday, the day off is transferred to the next working day after the holiday. Thus, in 2017, weekends are postponed:

  • from Saturday 4 November to Monday 6 November.

The exception is weekends that coincide with non-working holidays in January. In accordance with Art. 112 of the Labor Code of the Russian Federation The Government of the Russian Federation has the right to transfer two days off from the number of days off that coincide with non-working January holidays to other days in the next calendar year. Decree of the Government of the Russian Federation dated August 4, 2016 No. 756 provides for the transfer of days off:

  • from Sunday January 1 for Friday 24 February;
  • from Saturday 7 January to Monday 8 May.

In accordance with the “Procedure for calculating the norm of working time for certain calendar periods of time (month, quarter, year) depending on the established duration of working time per week,” approved by order of the Ministry of Health and Social Development of Russia dated August 13, 2009 No. 588n, this norm is calculated according to the five-day calculated schedule working week with two days off on Saturday and Sunday, based on the duration of daily work (shift):

  • with a 40-hour work week - 8 hours;
  • with a 36-hour work week - 7.2 hours;
  • with a 24-hour work week - 4.8 hours.

The length of the working day or shift immediately preceding a non-working holiday is reduced by one hour. In 2017, such pre-holiday working days are:

  • February 22;
  • March 7;
  • the 3rd of November.

The standard working time calculated in the specified order applies to all work and rest regimes.

An example of calculating the standard working time in November 2017 with a five-day work week with two days off (initial data: 21 working days, on November 3 the working day was reduced by 1 hour):

  • calculation for a 40-hour work week:
    (8 hours x 21 days) - 1 hour = 167 hours;

  • (7.2 hours x 21 days) - 1 hour = 150.2 hours;

  • (4.8 hours x 21 days) - 1 hour = 99.8 hours.

In 2017, 247 working days, including 3 working days reduced by one hour. Calculation of standard working hours for 2017 with a five-day working week with two days off:

  • with a 40-hour work week:
    (8 hours x 247 days - 3 hours) = 1973 hours;
  • with a 36-hour work week:
    (7.2 hours x 247 days - 3 hours) = 1775.4 hours;
  • with a 24-hour work week:
    (4.8 hours x 247 days - 3 hours) = 1182.6 hours.

1st of May falls on Monday, so citizens will have three days to rest: April 29, April 30 and May 1, respectively.

Thus, Russians will rest during the May holidays in the following order:

  • from April 29 to May 1
  • from May 6 to May 9 (since Monday will be a day off due to May 7, which fell on Saturday)

If this option is approved, then citizens of the country will work 20 working days in May and go on 11 days off, including 2 days of holidays.

May 1 – Labor and Spring Day

  • If a public holiday falls on a Saturday or Sunday, the day off is transferred to the next working day. In 2017, National Unity Day (4 November) falls on a Saturday, so the holiday moves to Monday 6 November.

    The Government of the Russian Federation has the right to make changes to the production calendar, shift two days off from those that coincide with non-working holidays on January 1-8, to other dates in order to rationalize the labor process (Part 2 of Article 112 of the Labor Code of the Russian Federation). Therefore, for 2017 the following transfers of weekends have been approved:

    • from Sunday January 1 to Friday February 24;
    • from Saturday 7 January to Monday 8 May.

    Pre-holiday days

    On the eve of official state holidays, working hours are reduced by 1 hour, the same for both a 40-, 36- and 24-hour five-day work week (Part 1 of Article 95 of the Labor Code of the Russian Federation). If a holiday falls on a Sunday, then the work hours on Friday are not reduced. In 2017, there are 3 such pre-holiday days in Russia: February 22, March 7 and November 3.

    Weekend in May 2020

    This year, the transfer of rest days was approved by a government decree (the document is still in draft form). As many as three winter weekends have been moved to May:

    • January 4 - May 4;
    • January 5 - May 5.

    So, in May there are two holidays waiting for us - May 1 - Spring and Labor Day, the second - May 9 - Victory Day. In this regard, we will rest like this:

    1. The first period is from May 1 to May 5 (5 days);
    2. The second period is from May 9 to 11 (3 days).

    May 1 – Labor Day, or Spring and Labor Day. According to Article 112 of the Labor Code of the Russian Federation, it is considered a non-working holiday. Next, May 2 and 3 are Saturday and Sunday weekends, May 4 and May 5 are weekends postponed from January. April 30 is a shortened pre-holiday working day - shortened by one hour.

    May 9 is the second holiday in May - Victory Day. May 10 - Sunday. And on the 11th we rest for the 9th, which falls on Saturday. Therefore, we will rest for three days in a row - from May 9 to May 11 inclusive.

    How to book holidays in May 2020

    Between holidays and after holidays there are working days. In total, according to the production calendar of the 20th year, in May:

    • 31 - calendar day;
    • 17 - working days;
    • 14 - weekends and holidays.

    Working hours in May:

    • with a 40-hour work week - 135 hours;
    • at 36 hours - 121.4 hours;
    • at 24 hours - 80.6 hours.
    Let us remind you that during working hours, an employee must perform his duties in accordance with internal labor regulations and the terms of the employment contract. Normal working hours cannot exceed 40 hours per week. The employer is obliged to record the time worked.

    But there are three working days between the holidays in May 2020, during which many people prefer to rest. You can arrange and pay for this time in different ways. We will tell you about possible payment methods and features (see table).

    Another vacation

    If the vacation is on schedule, the employee only needs to be notified of the start of the vacation two weeks in advance and an appropriate order is issued. If not on schedule, the employee must write a statement.
    According to the general procedure, vacation pay in this case is issued three calendar days before the start of the vacation (Article 136 of the Labor Code of the Russian Federation).

    The amount of vacation pay will depend on the number of vacation days. You can take a vacation for six days, including weekends - this way there will be no loss in salary.

    Unpaid leave

    An employee can take unpaid leave for the May holidays. To do this, you need an application indicating the start date of the vacation and the number of days of rest. In this case, vacation pay is not paid. And the salary is calculated for the days worked in May.

    Time off Employees who previously worked overtime can take time off on May weekends and holidays (Article 153 of the Labor Code of the Russian Federation). An application with dates is required. PTO days reduce working hours in May. If the employee works the remaining days, he will receive full salary
    Downtime at the initiative of the employer Between holidays in May, the company may declare downtime for specific employees, departments, or all personnel. To do this, an order is issued that all employees must familiarize themselves with. If the employer is to blame for the downtime, at least 2/3 of the average salary is paid. If the downtime does not depend on the company and employees, then 2/3 of the salary (Article 157 of the Labor Code of the Russian Federation).
    Weekends in the organization The company may declare public holidays in May as days off. Employees must be notified of the decision in a separate order. You can pay for these days according to average earnings or set a reduced standard of working hours for May. That is, instead of 143 hours, write down 119 hours (143 hours – 8 hours × 3 days). Then employees are entitled to a full salary for May if they work 119 hours. Additional days off are not paid in this case.
